Description
David, king of Scots, has given his beloved and faithful John Herries, knight, the barony of Terregles in the sheriffdom of Dumfries, which belonged to his beloved relative (consanguineus) Thomas, earl of Mar, and which he resigned before the magnates and prelates of the realm by staff and baton; holding by John and his heirs or assigns, in feu and heritage, in perpetuity, as one free and integral barony, with bondsmen and bondages, neyfs and their offspring, and with the services of the freeholders and tenancies of the barony, and with advowsons of churches, and with all the liberties found by a faithful and diligent inquest made by his sheriff of Dumfries, made by the best and eldest of the sworn men of the sheriffdom, and returned to his chapel, ought to belong to the barony by right and custom. First, namely that the barony is held from the king in free barony; that there must be two roads through the barony, one by length and the other breadth; and that the said barony is free of sorryn (duty to quarter men) and fathalos, unless a sergeand comes through the barony with a robber or with a head of robbers, and if they happen to pass through before the sun sets, they will have nothing to expend; and if they are not outwith the barony by sunset, they will have to provide hospitality for them for that night, or the men of the said barony will receive the robber or head of robbers from the sergeand to keep for that night, and to deliver to the sergeand the following sunrise. And no royal sergeand or coroner should perform his office within the barony unless he first comes to the _chymys_ (chief house) of the lord of the barony, and presents there his attachments regarding certain persons to the constable or baillie of the said barony, and if the baillies concedes that they are men of his lord living within the said barony, the same baillie will be pledged to enter them in the presence of the justiciar, and if the baillie does not concede that they are men of his lord, the coroner or sergeand of the coroner should perform his office in the said barony with witnesses. And if the coroner or his sergeand discovers any fugitives, the lord of the barony will have his goods and not the king. And if they find anyone and the baillies wants to repledge him, the king's coroner or his sergeand will lead the aforesaid person with his good to the king's prison. And that the men of the barony ought not respond to the victualing of the neighbourhood watch (_custodis patrie_), the justiciar or sheriff. And the men of the barony ought not respond to the king's army. And that no coroner or other person should ransel (search houses) within the barony unless a pledge has discovered that that house is culpable. And if anyone's goods be chased down by scent, that he may not ransel without licence of the sergeand of the barony. And that no one must respond to any carriage, except for the king's, and then only to the bounds of the barony. And that they may be paid for any horse, one penny for four _leucis_ (measure of distance). Similarly with pit and gallows, sake and soke, toll and team, and infangenthef, as freely as the said earl held it before his resignation, for service owed and wont.
