Pope Innocent III writes to the abbots of Arbroath and Lindores and the prior of May, stating that the prior and convent of St Andrews have mentioned that some time ago a suit between them and M., clerk of Perth, concerning the church of Rossie (PER) was committed to the bishop of Dunkeld and his co-judges, so that within six months of receiving the papal letters they should determine the case regarding the question of proprietary right. The same judges received old and infirm witnesses before the contestation of the suit; but, with the said M. having gone the way of the flesh in the meantime, the prior and canons, coming to the bishop and stating their right in full synod that no one should be instituted to the same church to their detriment, they appealed to the apostolic see. The same bishop, though, holding their legitimate appeal in contempt, instituted William, a clerk of the diocese of Glasgow, into the said church. Pope Innocent therefore commands the above that if it is so, they shall bring that suit to an end within six months, without obstacle of appeal, causing what they establish to be firmly observed by ecclesiastical censure. If the witnesses named shall have withdrawn out of favour, hatred or fear, they shall compel them by a similar stricture, without appeal, to provide testimony of the truth, and no letter obtained from the apostolic see shall prejudice truth and justice. If all of them cannot take part in carrying this out, let two of them do it.
