Document 4/32/3 (SEA, i, no. 104)

Description
Jocelin, bishop of Glasgow announces that he and Osbert, prior of Paisley, have been delegated by the pope to settle the dispute between Kelso Abbey and Hervey, marischal of the king, over the church of Keith-Marischal (ELO), which the monks claimed as a chapel, declaring that it should belong to their church of Keith (Humbie, ELO). After the abbot had produced sufficient witnesses, the discussion concluded with Hervey giving to the monks in free and perpetual alms 20s. annually from his church of Keith-Marischal free and quit of all custom and service. The persona of the church shall, within forty days, take an oath to the monks concerning the pension to be paid annually. Future personas shall do the same. Hervey and his heirs may not grant the church to any religious house except Kelso. Hervey, his heirs and the monks pledged themselves to observe this agreement.
