Bishop Jocelin of Glasgow announces that this agreement was made in his presence before Simon, archdeacon of Glasgow, for the preservation of peace and concord between the monks of Melrose and Uhtred of ‘Grubesheved’ (Grubbit, ROX) and his heirs. Uhtred and his heirs granted to Melrose Abbey the haughs beside Kale water by its correct bounds and divisions, that is, as the old course of that water was and as the bounds were positioned and perambulated between them on 9 April 1181 by Archdeacon Simon, Peter, persona of Morebattle, Robert Bosville, Thomas, son of Philip de Colville, Alexander the steward, Ralph of Ryedale, Robert of Barnoldby and other very many faithful and trustworthy men, and also Uhtred and his sons, Simon and Adam. Uhtred and his heirs quitclaimed those haughs to the monks of Melrose free and quit of all claim in perpetuity, and swore on the holy church of Melrose before the bishop, Arnold abbot of Melrose and Archdeacon Simon, that they would never presume to deviate from this agreement nor claim anything from the monks beyond the fixed and perambulated bounds and divisions, but as far as possible maintain and defend everywhere the house of Melrose and whatever pertained to it. In addition Uhtred and his heirs, with good spirit and agreement, granted the monks to have a way through their land of ‘Grubesheved’ across to the land of the monks so that their carts could adequately come and go to their grange of ‘Hunedun’ (Hownam Grange, ROX) without interference or obstruction. Uhtred and his heirs declared in the bishop’s presence, with their hands in that of Archdeacon Simon, to hold and guarantee without any trickery the whole of this agreement in perpetuity.
