Description
The chancellor of Moray, the treasurer of Dunkeld and Master John of Everley, canon of Dunkeld, recite letters from Pope Innocent [IV], appointing them papal judges-delegate and instructing them to investigate the petition from the abbots of Kelso, Arbroath and Lindores, and the prior of St Andrews, that since the bishop of Aberdeen, of good memory, at the assent and consent of his chapter, had granted certain churches in the diocese of Aberdeen to the priors and convents to hold the right of patronage for their own uses, the [current] bishop had prevented the vicars of the churches from paying their customary dues to the said monasteries. The abbot and convent of Arbroath appearing through their procurators before the judges in the parish church of Banchory-Ternan (KCD), 1250, Thursday after the feast of St Peter ad vincula, by a council of prudent men and skilled judges, the judges have assessed the vicarages and assigned portions to the vicars: the vicarage of the church of Banchory-Ternan assessed at 16 marks, the whole altarage with one acre of land and the garbal teinds of the same villa from cultivated land, saving yearly to the fabric of the church of Arbroath 40d. paid by the vicar, the garbal teinds of the villa after being cultivated, with lands belonging to the church and other garbal teinds in the parish remaining with the abbot and convent in full; the vicarage of the church of Banff assessed at 30 marks, the altarage of the church with the manse and altarage of Inverboyndie (Boyndie, BNF) with one acre of land, all the teinds of the fishery, both white and red fish, and the lands pertaining to the mother church and the chapel, and the garbal teinds in the parish remaining with the abbot and convent; the vicarage of the church of Gamrie (BNF), assessed at 18 marks, all the altarage with two acres of land, the land of the church and the garbal teinds in the parish remaining with the abbot and convent; the vicarage of the church of Fyvie (ABD) assessed at 33 marks, the altarage together with the land of ‘Ardincross’ (ABD?), reserving yearly 5 marks for placable wool or lambs and the garbal teinds; the vicarage of the church of Buthelny (now Old Meldrum, ABD) assessed at 15 marks, all the altarage with 6 marks in the garbal teinds in certain places, paid annually, of the lands then cultivated, [and] the remaining garbal teinds in the parish remaining with the abbot and convent; the vicarage of the church of Tarves (ABD) assessed at 32 marks, the altarage with one acre of land, reserving 8 marks paid annually from the teinds of wool or lambs or both and the garbal teinds in the parish remaining with the abbot and convent; the vicarage of the church of Kinnernie (ABD) assessed at 10 marks, all the altarage with a manse and 5 ½ marks in garbal teinds in certain places of the lands of the parish then cultivated, [and] the remaining garbal teinds in the parish remaining with the abbot and convent; the vicarage of the church of Coull (ABD) assessed at 12 marks, all the altarage with a manse and 4 ½ marks in garbal teinds in certain places of the lands of the parish then cultivated, [and] the remaining garbal teinds in the parish remaining with the abbot and convent; the vicarage of the church of Forglen (BNF) assessed at 100s., all the altarage with a manse and the garbal teinds of the land then cultivated, the remaining profits which after a while will grow above 100s., [and] the remaining for the uses of the abbot and convent, reserving to the judges the power to restrain molesters of the settlement by ecclesiastical censure; all the vicars of the said churches shall sustain all ordinary burdens and shall answer for their portion from the fabric of the chancery of the churches and from extraordinary burdens.
