Description
An agreement was formed between the abbot and monks of Kelso and Hervey, the marischal, in the controversy over the church of his villa of Keith (i.e. chapel of Keith-Marischal) (ELO), whereby the abbot and monks of Kelso quitclaimed to Hervey the suit that they had against his church, and Hervey gave to the monks in free and perpetual alms 20s. yearly in the church of Keith (i.e. chapel of Keith-Marischal) free and quit of all service and customs. The monks may not expel anything from the church, unless by their good wish, but Hervey is not permitted to grant the church to another place of worship, unless [it is] the place of Kelso; but after the death of the present persona, who shall pay the said yearly pension of 20s., Hervey may wish to give a clerk to the church, who shall swear to pay the annual pension to the abbot and monks, and afterwards the abbot and Hervey shall present the clerk to the bishop from whom he shall accept the cure of souls.
