Description
In 1302 an agreement is made between Sir Nicholas Hay, lord of Erroll, on the one hand, and William called Old, son the late John called Old, burgess of Perth, on the other, viz.: that Sir Nicholas will apply his court, and will give faithful diligence and council to William, to seek out and extort the debt from William’s debtors which is being owed to the late John Old and William by reason of him. In return, Sir Nicholas will receive and will have, for his aid and labour, a third part of all the recovered debts of the said debtors. And if it happens that, through the death or poverty of any of the debtors, they are not able to recover the debt, nor extort it from the debtors, William Old grants and faithfully promises, for him, his heirs and his executors, that Sir Nicholas may have a reasonable allocation in two parts of the whole debt which he acquired, on the account that Sir Nicholas was not able to recover or to have the whole third part of the debts faithfully promised to him, and William is being held for his aids and labour. And so that everything will be observed, the parties supplied a corporal oath, and penalties are stipulated for failure.
