- Description
- Bernard Fraser, son of the late Sir Alexander Fraser the knight, states that he is to be held and obliged to John of Lamberton, lord of Polmaise-Marischal (STL), son of the late Richard of Lamberton, for four marks of good and legal sterling as 'gersum', because John infeft him anew with the land of Slamannan (STL), which he (Bernard) bought from Richard of Lamberton, John Lamberton's uncle. The money is to be rendered to John or his representative, the carrier of the present [letter], in the villa of Stirling, at the feast of Pentecost in 1295, without any great delay or opposition. And if it happens that John, or his representatives, are to record any penalty, to incur any loss, or to accrue expenses by the occasion of the money not being paid at the said time and place, Bernard obligates himself and his heirs through all their goods, movable and immovable, wherever they may have been found, to be distrained, seized and held (without license to sell), until such time the principal debt from the payments, losses and expenses may be fully satisfied. Further penalties are also stipulated for failure of payment.
