- J[ohn], bishop of Dunkeld, with Abbots W[illiam (II)] of Holyrood and H[ugh] of Newbattle, announces that the pope has commissioned them to settle the long dispute between the canons of Jedburgh and Adam, son of Gilbert, over the chapel of Hutton (DMF). By the authority of the ordinary, the bishop of Glasgow, and of the judges-delegate, the dispute was settled as follows. Adam gave and confirmed the chapel of Hutton in perpetual alms to Jedburgh Abbey and promised that he was about to petition that the king, and those from whom Adam held the lands of Hutton would confirm it, so that the chapel would be entirely exempt from the mother church of Sibbaldbie (DMF) and receive both the name and the right of a mother church and have a cemetery there. Adam gave in addition eight acres of land which the church had for the maintenance of the chaplain of the church. Walter, the clerk, who formerly held the chapel on behalf of the canons, shall hold it in peace for life with Adam’s consent and good will, and when he demits office the clerk presented by Adam to the abbot of Jedburgh for the church of Hutton shall be received by the abbot and presented to the bishop of Glasgow for institution, and the clerk shall pay 20s. annually from the church to the church of Jedburgh by way of a pension. After the clerk has left, Adam or any of his heirs shall not sell him any right in the church, but the church shall belong in full right to the disposal of the abbot and convent of Jedburgh. If anyone raises a question against the canons over the church on account of this agreement, Adam shall exercise good faith so that no prejudice to the canons can arise. For greater security, and so that it will be observed firmly by both parties without fraud or evil intent, the abbot of Jedburgh in his own name and that of his convent and Adam for himself and his heirs faithfully secured it by pledging faith in the hands of the judges.
