Description: Simon Bayard and Isabella, his wife, are in amercement for many defaults, versus William Comyn and Euphemia, his wife. Simon and Isabella were summoned to answer to William and Euphemia in a plea that they should deliver to them 540 marks which they owe. William and Euphemia, by attorney, say that a certain Euphemia, grandmother of Euphemia, infeft the latter in the manor of Athelgalthwyn in Scotland of the grandmother’s heritage. She delivered the same to Isabella to be kept for the use of the said Euphemia for three years, answering to the latter for 100 marks yearly, as she was underage. Isabella, at the end of the term, acknowledge that she owed Euphemia 300 marks; so that the latter granted to Isabella the manor to be held for three more years, paying 80 marks yearly. Isabella likewise acknowledge that she owed 240 marks, the total being 540 marks; and granted her in writing to pay the sum. But Simon and Isabella have since detained the money whereby William and Euphemia say they are in damages of 1000 marks, therefore bringing suit. Simon and Isabella say they were not bound to answer the writ as the manor in question is outside the kingdom of England, and they are in sasine of the same, by the feoffment of Euphemia, grandmother of Euphemia and mother of Isabella. Likewise, the contract of debt was proffered by the plaintiffs outside of England, nor are the witnesses of that kingdom [except Simon Bayard only]. Simon and Isabella are the king of England’s ‘men’ and in his power and have nothing in the said manor save by the demise of the plaintiffs. A day is given to them to hear their case in a month from Holy Trinity at Chelmerford. Simon appears by Robert Scherwind or Thomas of Ireland. And Isabella appears by John Bayard or William le petit.
