- Description
- David, king of Scots: since, from the deliberation of his council in his full parliament held at Scone, it was formerly declared that the late John Burnard, relative of his beloved and faithful William of Dissington, knight, at the castle or fortalice of Liddel, was fatally wounded by our English adversaries, at the time when he was personally in the same place, and also soon afterwards was received within the king's castle of Roxburgh throughout the time which the said castle was in his possession, and after Eustace de Lorraine returned the said castle to the English, the same John Bernard, lying in the same place, and rendered powerless by reason of the said injuries, labouring in the process of time in the course of a long illness, finally died from the said wound, and that the third part of the moiety of the barony of Ardross (FIF), along with the third part of the barony of Currie (MLO), which was the same late John’s, were granted by the king's lieutenant to the aforementioned William of Dissington as the heir of the same late John, while we were in distant parts; for this very William it was also declared by our said council that he is, and ought to be, the true and legitimate heir of the same late John, his relative, concerning the said lands with pertinents, notwithstanding that, not willingly delaying in the same place, but forced by the said injury, he died in the said castle while it was held by the English, and that, before the king knew about the lawful position of the said William, he granted the same lands to Alexander Maitland on behalf of whom a plea was made to the king, and who, from the said declaration, is established to have no right in the said lands by reason of the king's said grant. Know that the king, having discussed this a second time, from the mature deliberation of his council in his parliament held at Perth, has given the same William of Dissington, knight, the aforesaid third part of the moiety of the barony of Ardross (FIF) and the said third part of the barony of Currie (MLO), which right in the same lands the king declares to be competent by hereditary right, as was stated above; holding in feu and heritage, for custom owed and wont.
