Description
The abbot of Newbattle, the abbot of Holyrood and Simon of Lindsay, canon of Dunkeld, recite letters of Honorius [III], appointing them papal judges-delegate in the case was being considered between the nuns of North Berwick pursuing on one side, and the monks of Dunfermline defending on the other concerning the teinds of wheat, of fish and of the mill of Airthrey (STL) and of Cornton (STL). In addition, a case was called between the said monks and nuns concerning all the teinds of Kilbrackmont (Kilconquhar, FIF) and the teinds of fish of their parishioners of Newburn (FIF), by the authority of the pope, whose letters they also recite here, directed to the abbots of Kelso and Melrose and the archdeacon of Lothian, appointing them papal judges-delegate in the case complained to the pope from the abbot and convent of Dunfermline and W[illiam], rector of the church of Kilconquhar, St Andrews diocese, concerning certain teinds, before officials of St Andrews. By common assent and wish of the parties, H[erbert], abbot of Kelso, and H[ugh], abbot of Dryburgh, and Master S[…] of Lilliesleaf, and W[…] of Ednam, and Sir Ness of Ramsey [were elected by the abbot of Dunfermline, the nuns, by the consent of Sir Ness of Ramsey, procurator of the same, and Lady Alicia, sub-prioress of North Berwick] and the case brought forward was ordained in the following manner by the counsel of prudent men, for good peace between the monasteries: that the monks of Dunfermline, without contradiction or molestation shall pay annually to the nuns of North Berwick three chalders of oat flour from the teinds of Cornton, in the villa of Cornton by the hand of the minster of the church of Stirling, at Easter. In addition, the nuns shall have all the teinds of the mill without the multure of Airthrey and Cornton with all the suit of the said mill. The monks, safe and quit from all claims and complaints, shall remain with all the garbal teinds and of fish of Airthrey and Cornton towards the west, from the head of the causeway next to the hospital up to the peatary of Airthrey, below the hospital and around the south part through the ditch towards ‘Burgrevisflat’, and through the same ditch towards the villa of Airthrey up to the stream of ‘Geffraisburne’; and from that stream above the mountain up to ‘Glackinlouy’, up to ‘Albethy’ and thus up to the Allan, except the teinds of a certain portion of ‘Burgrevisflat’, towards the peatary which is accustomed to being ploughed, towards the villa of Airthrey and the bridge of Stirling; and except 6 crofts of the grithmen of Airthrey and all their plots, from which the nuns shall receive the teinds; in addition, the nuns shall receive all the teinds of Airthrey towards the east between the named marches and the church of Logie (STL); except the teinds of ‘Floris’ and of a certain portion of land in the east part of that road which leads from the hospital up to Airthrey which the monks shall pay. The monks shall obtain and hold in peace the teinds of the lands of the hospital situated between the causeway and Cornton which those nuns quitclaimed; the nuns also quitclaimed the teinds of ‘Florys’ with another portion adjacent to it. The teinds of Kilbrackmont and teinds of fish from the fisheries of Newburn – which they will bring to the land in the parish of Kilconquhar on returning from the fishery, which the monks had claimed – shall remain with the church of Kilconquhar safe and quit from all claims and complaints. This agreement was sealed by Bishop W[illiam] of St Andrews and Bishop A[braham] of Dunblane, as well as by the named judges.
